Information on data transfer to the USA and other non-EU countries

Among other things, we use tools of companies domiciled in the United States or other from a data protection perspective non-secure non-EU countries. If these tools are active, your personal data may potentially be transferred to these non-EU countries and may be processed there. We must point out that in these countries, a data protection level that is comparable to that in the EU cannot be guaranteed. For instance, U.S. enterprises are under a mandate to release personal data to the security agencies and you as the data subject do not have any litigation options to defend yourself in court. Hence, it cannot be ruled out that U.S. agencies (e.g., the Secret Service) may process, analyze, and permanently archive your personal data for surveillance purposes. In all other cases the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6(1)(f) GDPR) or on your agreement (Art. 6(1)(a) GDPR) if this has been requested.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g., after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions, in particular retention periods.

Request by e-mail, telephone, or fax

5. Registration for events

You can register on the website for events organised by our company or events at which our company is represented as a guest or speaker. The basis for processing your data for participation in events is Art. 6 para. 1 p. 1 lit b) DSGVO. The processing is necessary for the establishment, implementation or termination of legal transactions with our company (e.g. also in the case of the transfer of data to a payment service provider/shipping company for the processing of a contract with your person).

In the registration form, you must enter your name, your company and your e-mail address. The purpose of the processing is to maintain contacts in the IT sector and to improve our external presentation and our public relations work. Insofar as you have expressed your interest in a personal appointment, your data will also be processed for the preparation and implementation of the appointment.

We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are statutory retention obligations.

6. Social media

Social media plug-ins with Shariff

We do use plug-ins of social media networks on this website and its pages (e.g. Facebook, Twitter, Instagram, Pinterest, XING, LinkedIn, Tumblr).

As a rule, you will be able to recognize these plug-ins because of the respective social media logos that appear. Contract data processing

We have executed a contract data processing agreement with Google and are implementing the stringent provisions of the German data protection agencies to the fullest when using Google Analytics.

Demographic parameters provided by Google Analytics

This website uses the “demographic characteristics” function of Google Analytics, to be able to display to the website visitor compatible ads within the Google advertising network. This allows reports to be created that contain information about the age, gender, and interests of the website visitors. 9. Plug-ins and Tools

YouTube with expanded data protection integration

Our website embeds videos of the website YouTube. The website operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the expanded data protection mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they watch the video. Google Maps

This website uses the mapping service Google Maps. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To enable the use of the Google Maps features, your IP address must be stored. As a rule, this information is transferred to one of Google’s servers in the United States, where it is archived. The operator of this website has no control over the data transfer. In case Google Maps has been activated, Google has the option to use Google web fonts for the purpose of the uniform depiction of fonts. When you access Google Maps, your browser will load the required web fonts into your browser cache, to correctly display text and fonts.

We use Google Maps to present our online content in an appealing manner and to make the locations disclosed on our website easy to find. This constitutes a legitimate interest as defined in Art. 6(1)(f) GDPR. If a respective declaration of consent has been obtained, the data shall be processed exclusively on the basis of Art. 6(1)(a) GDPR. This declaration of consent may be revoked at any time.

10. Online-based Audio and Video Conferences (Conference tools)

Data processing

We use online conference tools, among other things, for communication with our customers. The tools we use are listed in detail below. If you communicate with us by video or audio conference using the Internet, your personal data will be collected and processed by the provider of the respective conference tool and by us. The conferencing tools collect all information that you provide/access to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).

Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Should content be exchanged, uploaded, or otherwise made available within the tool, it is also stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/ instant messages, voicemail uploaded photos and videos, files, whiteboards, and other information shared while using the service.

Please note that we do not have complete influence on the data processing procedures of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, and which we have listed below this text.

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest in the meaning of Art. 6(1)(f) GDPR). Insofar as consent has been requested, the tools in question will be used on the basis of this consent; the consent may be revoked at any time with effect from that date.

Duration of storage

Data collected directly by us via the video and conference tools will be deleted from our systems immediately after you request us to delete it, revoke your consent to storage, or the reason for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal retention periods remain unaffected.

We have no influence on the duration of storage of your data that is stored by the operators of the conference tools for their own purposes. For details, please directly contact the operators of the conference tools.

We use Webex. The provider of this service is the Webex Communications Deutschland GmbH, Hansaallee 249 c/o Cisco Systems GmbH, 40549 Düsseldorf, Germany.

It cannot be ruled out that data processed via Webex will be transferred to third-party countries (e.g. USA). Webex has Binding Corporate Rules (BCR) which have been approved by the Dutch, Polish, Spanish, and other relevant European Data Protection Authorities. 11. Custom Services

Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g., via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g., contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6(1)(b) GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6(1)(a) GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 GDPR and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6(1)(a) GDPR) or if statutory data retention requirements preclude the deletion.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. In case of admission, all documents and information from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

Admission to the applicant pool is based exclusively on your express agreement (Art. 6(1)(a) GDPR). The submission agreement is voluntary and has no relation to the ongoing application procedure. The affected person can revoke his agreement at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for storage.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

Applicant Management System

We use the web applications of pludoni GmbH (Pillnitzer Landstraße 73 b, 01326 Dresden, Germany) to process applicant data. Applicant data is created automatically or manually in these applications.

In the following, we would like to explain what data we collect in this context and what happens to this data.

(a) Purpose of data processing

We process the data that you send us in connection with your application in order to check your suitability for the advertised position and to be able to carry out the application procedure.

The application is digitally processed by our application tool. The digital processing enables us to better track the status of your application and assign it to the appropriate contact person.

(b) Legal basis for data processing

The processing is carried out in accordance with Art. 88 Para. 1 DSGVO in conjunction with § 26 BDSG and Art. 6 Para. 1 lit. a DSGVO.

In the event that you provide us with personal data of a special category, such as health information, the processing is based on your consent pursuant to Art. 9 (2) lit. a DSGVO.

(c) Recipients of the data

Only we have access to the applicant data.

(d) Duration of storage

Your data will generally be deleted/anonymised after 13 months at the latest in the event that an employment relationship is not established, unless there is a legitimate interest in the continued storage of the data in exceptional cases.

If you have allowed us to include the data in our applicant pool as part of a separate consent, we will store your data for one year.

(e) Possibility of objection and deletion

You may object to the processing at any time in accordance with Art. 21 DSGVO and request deletion of data in accordance with Art. 17 DSGVO. Please refer to point 1 of this data protection notice to find out which rights you are entitled to and how to assert them.

(f) Necessity of providing personal data

The information in the application form is neither contractually nor legally required, but is necessary for sending and processing the application. If you do not fill in the existing mandatory fields or do not fill them in completely, the application you have requested cannot be sent or processed.

Declaration of consent for the extended storage of applicant data

This consent is voluntary and independent of the current application. You can refuse to give your consent without giving any reasons and without any disadvantages for your application. Furthermore, you can revoke your consent at any time for the future at bewerbung (at) proficom.de.

You agree that proficom GmbH and its subsidiarie profi.com products GmbH may store your application data even after completion of the current application process.

You agree that proficom GmbH may use your personal data submitted during the application process to contact you if your profile later matches another vacancy.

This consent is effective for 5 years after the end of the current application process. If your profile is still of interest to us after this period has expired, we may ask you to extend the period again. Otherwise, we will delete all of your personal data thereafter.

12. Handling of data of our customers, business partners and visitors

Data and their origin

We process personal data from you such as surname, first name and contact details of contact persons, surname, first name and contact details of interested parties, planning data, in the case of the use of electronic media: IT usage data, possibly private details such as date of birth (voluntary), which we collect for the purpose of handling our business relations with the company you represent.

However, if you as a customer or business partner are a natural person, the following data, such as account details, which we collect from you in order to carry out pre-contractual and contractual measures, will be processed in addition to the above-mentioned data during the realization of the business operation.

If you visit us directly, we process the personal data provided by you in the course of a visit, such as Unique Identifier (e.g. ID card number), surname, first name, address, date of birth if applicable, time of arrival and departure, destination, recording data from the operation of video surveillance systems processed.

Data processing purposes and legal bases

In order to initiate or process contracts with our customers or business partners, we process your personal data as a contact person for the legitimate interests of the responsible party. In doing so, we always balance these with your personal rights. Therefore, as a rule, only the name and business contact data are used to document the business relationship and personal contact. The legal basis for this is Art. 6 para. 1 lit. f GDPR. If private data is processed, this is based exclusively on your consent in accordance with Art. 6 Para. 1 lit. a GDPR.

In the case of natural persons, your personal data that is required for the fulfillment of a contract or pre-contractual measures with you is processed. The legal basis for this is Art. 6 (1) lit. b GDPR. If information that is not absolutely necessary is processed, this is based exclusively on your consent in accordance with Art. 6 (1) lit. a GDPR.

As a party interested in information and products, we process your personal data either in the context of consent (Art. 6 para. 1 lit. a GDPR, e.g. marketing measures) or out of legitimate interest of the responsible party in consideration of your personal rights (Art. 6 para. 1 lit. f GDPR). In particular, the special requirements of the Unfair Competition Act (UWG) are taken into account.

As a visitor, we process your personal data to prove which persons have entered the secured company area on the basis of Art. 32 DSGVO.

In order to make our processes on the company premises demonstrably safe and to prevent damage to property and theft or to be able to document these in the event of damage, we operate a designated video surveillance system. This data collection is based on Art. 6 para. 1 lit. f GDPR.

In implementation of the status of an authorized economic operator (AEO) according to Article 76 Customs Code (Regulation (EEC) No. 2913/92) and Article 253 et seq. Zollkodex-DVO (VO (EWG) No. 2454/93) and/or in fulfillment of the EU counter-terrorism regulations (EG 881/2002 and 2580/2001), random checks are carried out at irregular intervals to determine whether you are considered a terrorist suspect.

Data recipient

We do not disclose your data to unauthorized third parties. However, to the extent necessary, data will be communicated to financial companies (transfers) and external contractors in accordance with Art. 28 GDPR as part of the processing of contracts with natural persons.

Third country transfer or transfer to international organizations

The transfer of your data to a third country or international organizations is not intended.

Storage period of your data

Your personal data will be deleted after expiry of the statutory retention periods, which result, for example, from the German Civil Code (BGB), the German Commercial Code (HGB) and the German Fiscal Code (AO).

If data is not affected by this, it is deleted when the purpose no longer applies.

Requirement of the provision of the personal data

If you are a natural person as a customer or business partner, your information is mandatory for the proper processing of the business relationship within the framework of contract processing and for contact persons of customers and business partners. Without your information, the legal transaction (debt relationship), the business relationship can not be properly processed, which could lead to the cancellation of the contract or the failure to make payments.
